We will of course both be appealing the magistrate’s egregious personal decision, whether the appeal is accepted or not, is another thing. One thing I didn’t include in the article because I wanted to keep it simple, there was a recent decision in the NSW Court of Appeals that struck down some anti-protest laws, that banned protesting in Bondi. In this case it was unanimously decided that laws cannot be passed on the basis of “legislating for social cohesion”, which the Commonwealth is relying on in their High Court arguments. This decision was made based on the NSW Court’s interpretation of the Australian Constitution and all its fundamental case law, they directly stated that it was “constitutionally illegitimate” to legislate on, or to try invoke “social cohesion” as a justification, because politics is inherently divisive. The White Australia Party lawyers reference this NSW decision at numerous points. The High Court will either have to accept the unanimous legal ruling by their peers in NSW, or overrule and set a new precedent. The case is Jarrett v State of New South Wales [2026] NSWCA 62
