BREAKING: The Ninth Circuit ruled that California cannot require federal immigration agents and other federal officers to display identification during enforcement operations, finding the law violates the Constitution's Supremacy Clause. California's No Vigilantes Act requires nonuniformed law enforcement officers to display their agency and name or badge number during arrests, detentions, and crowd control. Federal officers who violate the requirement could face misdemeanor prosecution. The court held that states cannot directly regulate federal law enforcement operations without congressional authorization. Judge Bennett wrote that California's law dictates how federal officers carry out their duties, violating the doctrine of intergovernmental immunity. California argued that the law was permissible because it did not substantially interfere with federal operations. The panel rejected that argument, holding that even minimal interference is irrelevant when a state directly regulates federal governmental functions. The panel went further than finding the federal government likely to prevail, declaring it "certain" to succeed on its constitutional challenge. It held that the identification requirement is invalid in every application to federal officers carrying out federal duties.
