📢 SC Malaysia: Illegal Stock Promotion Rules (Finfluencers & Unlicensed Promoters)
📚 Legal & Regulatory Basis
1️⃣ CMSA 2007
Giving investment advice / promoting capital market products = regulated activity.
Licence required.
Offence: fine up to RM10m, jail up to 10 years, or both.
2️⃣ SC Advertising Guidelines (Effective 1 Nov 2025)
Covers ads via social media & finfluencers.
Finfluencers = treated as advertisers (even without formal engagement).
Liability on both licensed entities & individuals who promote illegally.
⚠️ Takeaway: Promoting stocks or capital market products without SC licence/authorisation = illegal & heavily penalised.
