1️⃣ Constituent Assembly (1946–49)
• Draft Constitution originally had “Due Process of Law”
• Inspired by USA
❌ Removed deliberately
Why?
• Fear of:
• Judicial overreach
• Courts blocking socio-economic reforms
✅ Replaced with:
“Procedure established by law”
(Article 21)

2️⃣ A.K. Gopalan v. State of Madras (1950)
📌 First major interpretation of Article 21
• Supreme Court held:
• Procedure established by law = any procedure enacted by legislature
• Court cannot examine fairness or reasonableness
• Articles 14, 19, 21 read separately
❌ No due process
❌ No substantive rights
👉 Formal, narrow interpretation

3️⃣ Maneka Gandhi v. Union of India (1978) 🔥 TURNING POINT
This is where due process enters India indirectly.
SC held:
• Procedure under Article 21 must be:
• Just
• Fair
• Reasonable
• Articles 14, 19, and 21 are interconnected
📌 Effect:
Substantive Due Process introduced WITHOUT changing the text

4️⃣ Post-Maneka Expansion (1980s onwards)
Article 21 became a repository of rights:
Recognised as part of “life & personal liberty”:
• Right to livelihood
• Right to privacy
• Right to legal aid
• Right against custodial torture
• Right to speedy trial
• Right to clean environment
👉 Due process now deeply embedded in Indian constitutional law

5️⃣ Justice K.S. Puttaswamy (2017)
• Explicitly acknowledged:
• India follows substantive due process
• Overruled the Gopalan logic completely
• Privacy declared a fundamental right
