If a court were to conclude that the 2020 election was stolen from Trump based on clear, admissible, and outcome determinative evidence, American election law already provides a roadmap for meaningful remedies. Cases such as Marks v. Stinson demonstrate that when courts find proven election fraud affecting the outcome, they have not hesitated to remove certified winners and recognize the lawful result. Bell v. Southwell likewise shows that when constitutional violations fundamentally taint an election, courts may require a new election. Across the country, state and federal courts have repeatedly held that elections may be overturned, recounted, or rerun when fraud or illegality renders the true outcome uncertain. If a court were also to establish that the same unlawful conduct materially affected 2020 down ballot races (congressional, state legislative, gubernatorial), those contests would inevitably face intense legal and political scrutiny under their own governing laws. The actual remedy would depend on the evidence and the applicable constitutional + statutory framework, but confidence in the integrity of every affected race would be called into question. Such a development could fundamentally reshape the national political landscape. It could produce an unprecedented bipartisan demand to strengthen election safeguards, restore public confidence, and pursue structural reforms. In that environment, proposals that today appear politically unattainable (including a constitutional amendment under Article V) could become far more plausible if broad public consensus emerged. The Constitution already provides the mechanism: proposal by 2/3 of Congress (or a convention called by 2/3 of the states) and ratification by 3/4 of the states. History shows us that constitutional amendments often become politically possible only after extraordinary national events. If a court were to determine that the 2020 presidential election had been unlawfully decided (it was), the momentum for reform could be unlike anything we’ve seen in modern American history. Whether that momentum would ultimately produce an amendment remains a question for the American people, but the constitutional path exists.
