President Trump has removed the two Democratic members of the U.S. Election Assistance Commission (EAC), the federal agency responsible for distributing election grants, testing voting systems, and maintaining the national voter registration form.
The move is significant because it relies on a series of recent Supreme Court decisions that have greatly expanded the president’s authority over the executive branch.
For decades, many so-called “independent agencies” operated under laws that limited a president’s ability to remove commissioners except for specific causes such as misconduct or neglect of duty. In recent rulings, however, the Supreme Court has increasingly recognized that the Constitution vests executive power in the president, allowing him to remove executive officials—even those serving on independent commissions—who are exercising executive authority.
