How Pakadua Vivah Violates Article 21 (Right to Life and Personal Liberty):
1. Violation of Right to Marry with Free Consent:
• Article 21 of the Indian Constitution guarantees the right to life and personal liberty, which includes the right to marry a person of one’s choice.
• Forced marriages, as in Pakadua Vivah, directly infringe upon this right as free consent is absent.
2. Supreme Court Judgments Supporting This View:
• Shakti Vahini v. Union of India (2018): SC held that any form of coercion in marriage is a violation of personal liberty and dignity.
• Lata Singh v. State of UP (2006): SC emphasized freedom of choice in marriage as a fundamental right under Article 21.
• Asha Ranjan v. State of Bihar (2017): Reaffirmed that personal liberty and freedom to choose a partner fall within Article 21.
3. Right to Live with Dignity:
• Article 21 includes the right to live with dignity, which is destroyed when an individual is kidnapped and forcibly married.
