Recent 130th Constitutional Amendment Bill which seeks to automatically remove any minister including CM or PM from office if they are detained for 30 consecutive days for an offence punishable for five or more years. This amendment highlights deep structural imbalance in India's federal framework. Proposal seeks to insert a clause in Article 164 that deals with appointment and tenure of ministers in states, this amendment directly impacts states autonomy and federal principle. Yet this amendment can be directly passed by the parliament without the consent of states and reason it Article 164 is not explicitly mentioned in Article 368. For India to mature as a federal democracy it's important that constitutive units must have a meaningful voice in shaping and reshaping the constitutional impact There is need for expanding the list of provisions within Article 368 to include all matters that directly impact legislative and executive powers of states. #GS2 #Polity #PSIR #Federalism
