#Polity 🔴Gs-2 Vulnerable sections : Children ✅What is the Convention on the Rights of the Child - click here 🎖Protection of Children from Sexual Offences Act, 2012 🔴It was enacted to protect the children from offences of sexual assault, sexual harassment and pornography with due regard for safeguarding the interest and well-being of children. 🔴Bombay High Court held that - skin-to-skin contact is essential to constitute the offence defined under Section 7 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act). 🛑Section 354 of the Indian Penal Code, 1860, which deals with outraging modesty of women and which provides for a lesser sentence, was held to be applicable in such cases.

✅Gs2- Criminal justice system-Appointment of CBI Director ⚜️Background : 🅾️The Director of the CBI is appointed as per section 4A of the Delhi Special Police Establishment Act of 1946. 🅾️The Director of CBI has been provided security of two-year tenure in office by the CVC Act, 2003. 🅾️The Central Government shall appoint the Director of CBI on the recommendation of a three-member committee consisting of the Prime Minister as Chairperson, the Leader of Opposition in the Lok Sabha and the Chief Justice of India or Judge of the Supreme Court nominated by him.- This is done after The Lokpal and Lokayuktas Act (2013) amended the Delhi Special Police Establishment Act (1946) ⚠️In 2014- there is no recognized leader of opposition in the Lok Sabha,- Congress got just 44 seats-soLater, the Delhi Special Police Establishment (Amendment) Act, 2014 made a change in the composition-if there is no recognized leader of opposition- replace her/him with the leader of the single largest opposition party in the Lok Sabha

✅GS3- Mobilization of resources-Banking-> Insolvency=exit framework for capital ⚜️ Supreme Court of India gave a judgement on Essar Steel’s bankruptcy- SC has upheld the primacy of financial creditors over operational creditors- click here- It left out the issue of personal guarantors. ⚜️Recently Supreme Court upheld a government move to allow lenders initiate insolvency proceedings against personal guarantors. 🅾️What is personal guarantee?-concept of ‘guarantee’ is taken from Section 126 of the Indian Contracts Act, 1872-i.e. debtor fails to repay the debt to the creditor, the burden falls on the guarantor to pay the amount-The creditor reserves the right to begin insolvency proceedings against the personal guarantor if the latter does not pay. Usually, promoters of big businesses submit personal guarantees to creditors to secure loans and assure repayment.
