No indefinite withholding of assent: If the Governor withholds assent to a Bill, it must be returned to the Legislature; it cannot be kept pending endlessly. 2. Discretion under Article 200: The Governor enjoys limited discretion in granting or withholding assent and is not strictly bound by the Council of Ministers’ advice for this specific function. 3. Limited judicial review: The Governor’s decision under Article 200 is not justiciable, but Courts may intervene to direct the Governor to act within a reasonable time if there is prolonged, unexplained delay. 4. Article 361 immunity not absolute: The Governor’s constitutional immunity does not prevent the Court from issuing a direction to ensure a time-bound decision when there is undue delay. 5. No judicial timelines: The Court cannot fix strict timelines for the Governor’s decision on Bills under Article 200. 6. Same for President under Article 201: Courts cannot prescribe deadlines for the President’s assent process either. 7. President’s decision is non-justiciable: The President’s action under Article 201 lies outside judicial scrutiny. 8. No mandatory court guidance for President: The President is not required to seek the Court’s advice each time a Bill is reserved by a Governor. 9. No “deemed assent”: The Constitution does not recognise the idea of a Bill becoming law automatically due to delay in giving assent. 10. Article 142 cannot create deemed assent: The Court cannot invoke its extraordinary powers to manufacture “deemed assent.”
