Reasons:
1. Vacancies in judges post: more than 5k vacancies across all tiers
2. Judges population ratio: 15 per mn, Law commission recommends 50/mn, in USA it is 150/mn
3. Govt largest litigant -more than 50% pending cases
4. Increasing number of cases with increase in population+ greater awareness of rights + expanding govt regulation
5. Frequent adjournments -
6. Complex procedure
7. Poor court infra- 4200 courtroom deficiency, 0.09% of GDP spent on judiciary infra, 60% rooms lack power backup
8. Growing complexity of disputes
9! Limited use of ADR - Mediation, arbitration and lok Adalats.
Consequence: Justice delayed is Justice denied + Higher litigation cost+ reduce investor confidence+ overcrowded prisoners due to undertrial prisoners + erosion of public trust in the judicial system.
Reforms needed - address all the challenges.
