So I suspect at a minimum, we will not be able to be proscribed in future without the right of appeal, "due process" (at least the outward appearance of it) and the right to be taken off the prohibitted list in the future (like terrorist organisations can). In short, though I dont trust the Court to uphold our rights, I do expect them to reassert their own power and juristiction.

I think the main thing in favour of at least some repudiation of the Hate Group Laws by the High Court, is that of the Minister taking on the powers of the Court. Even if the Judges are corrupt, because the Commonwealth made the mistake of infringing on the territory of a different part of the system. The Court doesnt want to reliquish its own powers to politicians.
