Washington D.C., Nov. 2, 2023 — "The Securities and Exchange Commission today adopted new Regulation SE under the Securities Exchange Act of 1934 to create a regime for the registration and regulation of security-based swap execution facilities (SBSEFs). The new regulatory framework was required under Title VII of the Dodd-Frank Wall Street Reform and Consumer Protection Act relating to the over-the-counter derivatives market." The adoption of Regulation SE of the Security Exchange Act coordinates registration and reporting efforts between the SEC, CFTC, and the security exchange facilities. This execution takes place 60 days after registering with the Federal Register. This new requirement will adhere to reporting requirements that will create proper records between those with security based swaps such as foreign currency and other trades.
