✅How Drugs Are Regulated in India?
🔴The Drugs and Cosmetics Act1940: It entrusted various responsibilities to central and state regulators for regulation of drugs and cosmetics. It provides the regulatory guidelines for issuing licenses to manufacture Ayurvedic, Siddha, Unani medicines.
🔴Central Drugs Standard Control Organisation(CDSCO): Prescribes standards and measures for ensuring the safety, efficacy and quality of drugs, cosmetics, diagnostics and devices in the country. Regulates the market authorization of new drugs and clinical trials standards.
🔴Drugs Controller General of India: DCGI is the head of department of the CDSCO of the Government of India responsible for approval of licences of specified categories of drugs such as blood and blood products, vaccines and sera in India. DCGI also sets standards for manufacturing, sales, import, and distribution of drugs in India.
✅Govt of India Initiatives to improve healthcare sector in the country:
🔴Pradhan Mantri-Ayushman Bharat Health Infrastructure Mission (PM-ABHIM): it aims to strengthen India’s health infrastructure and improve the country’s primary, secondary and tertiary care services.
🔴Ayushman Bharat : Follows a two- pronged approach by Creation of health and wellness centres to bring health care closer to homes.
🔴Formulation of a Pradhan Mantri Jan Arogya Yojana (PMJAY) to protect poor and vulnerable families against financial risk arising out of health episodes.
🔴Ayushman Bharat Digital Mission: aims to connect the digital health solutions of hospitals across the country. Under this, every citizen will now get a digital health ID and their health record will be digitally protected.
🔴National Ayush Mission: it is a centrally sponsored scheme for the development of traditional medicines
🔴Pradhan Mantri Swasthya Suraksha Yojana (PMSSY):aims to correct regional imbalances in the availability of affordable/reliable tertiary healthcare services and also to augment facilities for quality medical education in the country.

🔴आयुष्मान भारत: स्वास्थ्य देखभाल को घरों के करीब लाने के लिए स्वास्थ्य और कल्याण केंद्रों के निर्माण द्वारा दो-आयामी दृष्टिकोण का पालन किया जाता है।
🔴गरीब और कमजोर परिवारों को स्वास्थ्य संबंधी घटनाओं से उत्पन्न होने वाले वित्तीय जोखिम से बचाने के लिए प्रधानमंत्री जन आरोग्य योजना (पीएमजेएवाई) का निर्माण।
🔴आयुष्मान भारत डिजिटल मिशन: इसका उद्देश्य देश भर के अस्पतालों को डिजिटल स्वास्थ्य समाधानों से जोड़ना है। इसके तहत अब हर नागरिक को एक डिजिटल हेल्थ आईडी मिलेगी और उनका स्वास्थ्य रिकॉर्ड डिजिटल रूप से सुरक्षित रहेगा।

✅Custodial Death: According to the Law Commission of India, the crime by a public servant against the arrested or the detained person who is in custody amounts to custodial violence.
✅Types of Custodial Death:
🔴Death in Police Custody: Death in police custody can result from excessive force, torture, denial of medical care, or other forms of abuse or incidental cause.
🔴Death in Judicial Custody: Death in judicial custody may occur due to overcrowding, poor hygiene, lack of medical facilities, inmate violence, or suicide.
🔴Death in the Custody of the Army or Paramilitary Forces: It can happen through torture or extrajudicial killings.
✅Constitutional Provisions:
🔴Article 21 of the Constitution of India guarantees the right to life and personal liberty, which includes the right to be free from torture and other cruel, inhuman, or degrading treatment or punishment.
🔴Article 20 grants protection against arbitrary and excessive punishment to an accused person, whether a citizen or foreigner or legal person like a company or a corporation.
✅The Nelson Mandela Rules, 2015:
🔴The Nelson Mandela Rules were adopted by the United Nations General Assembly in 2015 to treat prisoners with inherent dignity and to prohibit torture and other ill-treatment.
✅United Nations Convention Against Torture (UNCAT):
🔴It is an international human rights treaty under the purview of the United Nations that aims to prevent torture and other acts of cruel, inhuman, or degrading treatment or punishment around the world.
✅Strengthening Legal Systems:
🔴Enacting comprehensive legislation explicitly criminalising custodial torture like Supreme Court directives in Prakash Singh Case 2006.
✅हिरासत में मौत: भारत के विधि आयोग के अनुसार, गिरफ्तार या हिरासत में लिए गए व्यक्ति के खिलाफ एक लोक सेवक द्वारा किया गया अपराध हिरासत में हिंसा के बराबर है।
हिरासत में मौत के प्रकार:
🔴पुलिस हिरासत में मौत: पुलिस हिरासत में मौत अत्यधिक बल, यातना, चिकित्सा देखभाल से इनकार, या अन्य प्रकार के दुर्व्यवहार या आकस्मिक कारण से हो सकती है।
🔴न्यायिक हिरासत में मौत: न्यायिक हिरासत में मौत भीड़भाड़, खराब स्वच्छता, चिकित्सा सुविधाओं की कमी, कैदी की हिंसा या आत्महत्या के कारण हो सकती है।
🔴सेना या अर्धसैनिक बलों की हिरासत में मौत: यह यातना या न्यायेतर हत्याओं के माध्यम से हो सकती है।
✅संवैधानिक प्रावधान:
🔴भारत के संविधान का अनुच्छेद 21 जीवन और व्यक्तिगत स्वतंत्रता के अधिकार की गारंटी देता है, जिसमें यातना और अन्य क्रूर, अमानवीय, या अपमानजनक उपचार या सजा से मुक्त होने का अधिकार शामिल है।
🔴अनुच्छेद 20 किसी आरोपी व्यक्ति को मनमानी और अत्यधिक सजा के खिलाफ सुरक्षा प्रदान करता है, चाहे वह नागरिक हो या विदेशी या कंपनी या निगम जैसा कानूनी व्यक्ति हो।
✅नेल्सन मंडेला नियम, 2015:

🔴Heart of the Rights: The Supreme Court has said that the right to life is not just mere existence, but that it includes all rights that make it a meaningful and dignified existence for an individual.
🔴In the 1980s, the SC read the right to a clean environment as part of Article 21.
🔴Virender Gaur v. State of Haryana (1994): Recognition that the right to a clean environment is an integral facet of the right to a healthy life.
🔴Right to Speedy Trial: In Hussainara Khatoon Vs. the State of Bihar (1979), the Supreme Court declared that the right to speedy trial is an essential component of fairness in criminal justice.
🔴Right to Health: In the case of Parmanand Katara Vs. Union of India (1989), the Supreme Court held that every doctor has a professional obligation to protect human life in emergencies.
🔴Right to Livelihood: In the Olga Tellis Vs. Bombay Municipal Corporation (1985) case
🔴Protection against Illegal Detention: In DK Basu Vs. State of West Bengal (1997) case
🔴Right to Shelter: In Chameli Singh Vs. State of UP (1996) case

🔴अच्छी सड़कों का अधिकार: 2004 के सड़क दुर्घटना मामले में, सुप्रीम कोर्ट ने फैसला सुनाया कि गड्ढों से मुक्त और पैदल चलने वालों और वाहनों के लिए सुरक्षित अच्छी सड़कें अनुच्छेद 21 के तहत जीवन के अधिकार का हिस्सा हैं।
