Bhattacharya, Editorial Director, Business Standard 👇👇 1. Retrospective Tax Amendment has 2 elements : Retrospective element and Capital Gains Tax(CGT). 2. In 2006 Vodafone acquired Shares of a Company (Hutchison Whampoa) and by this Vodafone gained the Capital. 3. Such huge Capital is gained by Vodafone which has its jurisdiction in India: And they didn't pay CGT. 4. Finally Judiciary said to make a law by which Central Govt made it and started taxing CGT even retrospectively(Previous acquisitions also will be taxed...comes from a back date). 5. This made a big burden for the companies: who have acquired Capital before 2012. 6. IMPACTS of Amendment: All prospective Investments and Transactions will now freely takes place...who were in fear of retrospectivity. 7. Both in Vodafone and Cairn cases : companies have got relieved and the suspectation has been ended. 8. The pending 18 cases: can now withdraw those cases and Not expect any dues from Govt of India. 9. The law will have major impact: and this depends on how pending 17-18 companies will act. 10. Tax terrorism fear is now withered away and more investment, stability will be there as we move forward. 11. We need to tackle the perception issues: How Govt looks at Taxation on the companies. 12. The Amendment should not wait for months already time is up: Companies are moving International Arbitrary courts and selling Indian assets abroad. 13. The bill itself has been 17+ companies who are undergoing issue of retrospective tax: Once bill will be passed then one can how what is best place to resolve it. 6. The Court has to balance the speedy delivery of Justice and also opponent's right to appeal. 4. Very stringent laws are there to protect women and children and amendments are made to increase punishments. 5. Still everyday we have female victims, Justice should not only delivered, but should be delivered within short time. 6. If FTCs are taking 8-10 years, what is the need of these courts. 7. Prevention is better than going courts: Family, schools are best places where behavior can be nurtured. 8. Recent case in Delhi: A 9 year old was raped by a priest and got killed and cremated after that. 9. We need to make society more sympathetic and more humane towards women and children. 10. No of crimes in rural areas go unnoticed and unreported : Many women and family come out after that. 11. Until reform take place at every place: Sex Education at school level should change the mindset of all the people. 12. There should be fear of law: but Knowledge of law, Everyone from police, People, Parent, Student would know what law is. 13. Women has to know : What is POCSO Act, Laws that prevent them, And whom to approach. 14. Sensitization must be done at every level: which changes the mindset of police, lawyer, women...almost everyone. 15. Expeditious justice and fair trail are fundamental of judiciary....There are criminal cases that take more than 10 years to give justice. 4. After Nirbhaya case, Many Amendments were made to make justice available within time. 5. As per report of Home Affairs Committee: Out of sanctioned strength pf 1023 Fast Track Courts(FTCs) only 597 are working. 6. State govt and High Court must also look after that FTCs are constituted and they are working. 7. But due to present Judicial systemic issues: Procedure delay, Unnecessary adjournment, Accused reluctant to come to court....etc. 8. Nirbhaya case was expeditious by subsidiary court: But other Cases are hardly given such justice. 9. Law making will not solve the problem: cases have increased even after stringent laws. 10. This is because: No victim is protected, Courts lack infrastructure where proper adjudication can be held, 11. Vacant judges: how can a judge with piling cases prefer which one to pick? 12. For prevention of crime it is awareness, advocacy and education are important steps. 13. Next is expeditious and fair trail and then the Legal system must be strengthened at the required level. 14.
